Depo of Witness M Vol. 1 (3-6-07)
The deposition transcript redactions are necessitated by a protective order sought and obtained by the Archbishop and his lawyers during the coordination proceeding. The following summary identifies by page and line number key portions of deposition testimony that would have been utilized had the Father Kelly cases proceeded to trial.
Nun Witness M served as the principal at the parish school from 1966-68. Nun Witness M's testimony was more remarkable for what she did not testify to than for what she did. Prior to her deposition she was interviewed by an investigator and went into great detail regarding Kelly having a drinking problem, how he was difficult to work with, how she thought he was a strange, angry and lonely man, and how he had to have problems other than drinking. However, a few weeks before her deposition she was contacted by someone from the Archdiocese. Depo page 72, line 9 to page 73, line 25; page 79, line 15 to page 82, line 17. After that contact, her recollection of events changed dramatically when compared with what she told the investigator. For cross-examination questions and testimony regarding this dramatic change see depo pages 68, line 25 to page 72, line 8; page 101, line 3 to page 110, line 13.
