The deposition transcript redactions are necessitated by a protective order sought and obtained by the Archbishop and his lawyers during the coordination proceeding. The following summary identifies by page and line number key portions of deposition testimony that would have been utilized had the Father Kelly cases proceeded to trial.
Nun Witness L lived in the convent next door to Father Kelly's parish during the period of abuse for at least two victims, 1956-60. One of those victims was Survivor Witness P. Nun Witness L knew survivor Witness P and his mother, Lay Witness K. Although Nun Witness L acknowledged knowing Lay Witness K and her son (Depo page 100, line 10 to line 13), she denied ever discussing Father Kelly with Lay Witness K (Depo page 103, line 18 to line 20). In fact, Nun Witness L's testimony regarding her knowledge of Father Kelly is directly contradicted by Lay Witness K. Compare Lay Witness K's testimony with Nun Witness L's testimony at Depo page 104, line 6 to page 108, line 18; page 109, line 17 to page 110, line 12. Nun Witness L denied outright each and every allegation testified to by Lay Witness K.
It is also worth noting that Nun Witness L denied any knowledge of the existence of any still living Sister of Bethany who was assigned to the convent before 1973 (the Archdiocese transferred Father Kelly from Santa Barbara in 1971). Depo page 71, line 10 to 15. However, Sister Angela Escalera – the Sister of Bethany at the center of the recent controversy regarding the Archdiocese's sale of the convent – was assigned to the convent beginning in 1964.
Finally, Nun Witness L has some disturbing answers to hypothetical questions posed to her at the end of the deposition regarding who she would have reported misconduct to if she had observed any. Starting at page 115, line 23 and continuing for a number of pages.
