The deposition transcript redactions are necessitated by a protective order sought and obtained by the Archbishop and his lawyers during the coordination proceeding. The following summary identifies by page and line number key portions of deposition testimony that would have been utilized had the Father Kelly cases proceeded to trial.
Lay Witness H lived in the cabin next door to Kelly with his wife, Lay Witness G. Depo page 7, line 19. He recalls that from the time Kelly moved in in 1958 until when he was transferred from Santa Barbara in 1970, Kelly would come to the cabin about once every 1-2 weeks, and often spent the night. Depo page 9, line 19. Sometimes he would visit the cabin multiple times in in one week. Depo page 9, line 19. Kelly would bring boys with him on about 75% of these trips; the boys appeared to be between the ages of 13 and 15 years old; sometimes he brought only one, sometimes more than one. Depo page 12, line 12; page 13, line 25. More often than not, if he was spending the night, Kelly brought only one boy. Depo page 15, line 11. The boys appeared to be Hispanic or Caucasian. Depo page 14, line 15. It was not unusual for Kelly to appear intoxicated. Depo page 18, line 9.
The witness observed the package containing child pornography belonging to Kelly sometime in the mid-1960s. Depo page 22, line 9. The boys in the photograph were entirely naked, and some had erections. Depo page 24, line 11.
After selling their cabin in 1983, the witness and his wife returned to the cabins around 2000. Depo page 31, line 1. The new owner of Father Kelly's cabin told the witness she had found pictures of naked boys in the cabin. Depo page 32, line 7.
