The deposition transcript redactions are necessitated by a protective order sought and obtained by the Archbishop and his lawyers during the coordination proceeding. The following summary identifies by page and line number key portions of deposition testimony that would have been utilized had the Father Kelly cases proceeded to trial.
Lay Witness G lived in the cabin next door to Father Kelly with her husband, Lay Witness H. Depo page 8, line 20. She recalls that from the time he moved in in 1958 until when he was transferred from Santa Barbara in 1970, Kelly would come to the cabin about once every 10 days, sometimes just for the day and sometimes to spend the night. Depo page 10, line 11. Kelly would bring boys with him on about half of these trips; the boys appeared to be between the ages of 15 and 20 years old; sometimes he brought only one, sometimes more than one. Depo page 14, line 7. More often than not, if he was spending the night, Kelly brought only one boy. Depo page 15, line 11. The boys appeared to be Hispanic. Depo page 16, line 7. It was not unusual for Kelly to appear intoxicated. Depo page 20, line 23.
Even after Kelly was transferred from Santa Barbara, he continued to visit the cabin, albeit less frequently, approximately every 4-6 weeks. Depo page 23, line 1. And again, he continued to bring teenage boys with him to the cabin. Depo page 24, line 15.
The witness and her children found child pornography in Father Kelly's mail sometime in the mid-1960s. Depo page 26, line 14. The boys in the photograph were entirely naked, and some had erections. Depo page 35, line 18; page 42, line 13.
After selling the cabin in 1983, the witness and her husband returned to the cabin around 2000. Depo page 37, line 21. The new owner told the witness she had found pictures of naked boys in the cabin. Depo page 38, line 10.
